Despite one tech companies efforts to stop the hologram Michael Jackson performance at Sunday’s Billboard Music Awards, the show will go on.

A man named Alki David, who claims his company controls the rights to the hologram technology, filed a lawsuit on Thursday against the Michael Jackson Estate, MJ’s production company and Dick Clark Productions. In the suit, he asked the court to block the digital performance, similar to his digitally resurrect of Tupac Shakur show at the 2012 Coachella music festival. What’s David reason for filing the suit? He claimed it would ruin HIS plans for a future high-profile holographic Jackson performance.

Well, a federal judge responded the the case on Friday and ruled that the awards show can use a hologram of deceased pop icon. According to the Associated Press, Judge Kent Dawson said there wasn’t “enough evidence to show the planned 3-D image would violate patents held by Hologram USA Inc. and Musion Das Hologram Ltd.”

Howard Weitzman, the lawyer for the MJ Estate, said “This is another Alki David stunt, no different than his claiming that Brandon Howard was Michael Jackson’s son.”

“The court’s decision is not surprising,” he said. “The request to stop this extraordinary Michael Jackson event was ludicrous…and the show goes on.”
